家犬咬死鄰居家畜？男不起訴

高雄市旗山區張姓婦人和江姓男鄰居都養雞，張婦指控江男養的黑狗在去年10月咬壞兩家間的圍籬，跑到張家咬死她所飼養的雞、鴨、鵝等家禽共29隻，損失3萬元，告江男毀棄損壞，檢方偵查後處分不起訴。

江男說他自己也飼養家禽，如果黑狗會咬家禽，那自己的家禽不就被狗咬死了？山上野狗很多，張婦不能看到黑狗就說是他的狗。檢察官認為沒有明確證據證明張婦的家禽是被江男的狗咬死的，也沒有辦法證明江男故意放狗亂咬，將江男不起訴。
